The personal information Axis collects, the purposes for which it is processed, the parties with whom it is shared, and the rights available to you.

Who we are

Axis Marketing AI, Inc., a Delaware corporation at 611 South Dupont Highway, Suite 102, Dover, DE 19901, United States, is the controller of the personal information described here. Axis is an AI marketing platform: we generate marketing material, schedule and publish it to channels our customers connect, and report on how it performs.

For any privacy question or to exercise a right, contact privacy@axismarketing.ai.

Where a business customer uses Axis to process personal data about their own customers, that business is the controller and we act as their processor. Our obligations in that role are in the Data Processing Addendum, and this Policy describes what we do as a controller in our own right.

What we collect

Connected account dataWhen you connect a social, advertising or analytics account, the data that account exposes to us within the permissions you grant. This can include profile and page information, posts, comments, messages, audience and performance metrics.
Usage and deviceIP address and the approximate location derived from it, browser and device type, operating system, pages viewed, features used, timestamps, referring URLs, and error logs.
CommunicationsEmails and messages you exchange with us, support tickets, and your marketing and SMS preferences with the record of when and how you gave or withdrew consent.
Consent recordsWhich version of which policy you accepted, when, and from which IP address and browser.

We do not seek to collect sensitive personal information, such as government identifiers, health data, biometric data or precise geolocation. Such data should not be submitted. Where your brand or content unavoidably involves such data, you are responsible for establishing a lawful basis for it.

Where it comes from

  • From you, when you create an account, set up your brand, buy a plan, use the product or contact us.
  • From platforms you connect, at your direction and within the permissions you grant.
  • Automatically, from your device and browser as you use the Service.
  • From our service providers, such as our payment processor confirming a transaction.

How we use it

  • Provide the Service: create your account, generate content, schedule and publish it, and report on results.
  • Bill you: take payment, manage renewals, apply taxes, and keep the records tax law requires.
  • Support you: answer questions and fix problems.
  • Keep the Service safe: detect and prevent fraud, abuse, automated signups and misuse of credits.
  • Improve the Service: understand which features are used and where people get stuck. We do our product analytics in-house.
  • Improve our AI: within the strict limits in section 6.
  • Communicate with you: service messages you cannot opt out of while you hold an account, and marketing you can.
  • Meet legal obligations: tax, accounting, record-keeping, and responding to lawful requests.

Legal bases

If you are in the European Economic Area, the United Kingdom, Switzerland or another place that requires one, we rely on:

Artificial intelligence and training

This section governs the use of customer material to develop and improve the artificial intelligence systems underlying the Service. Axis may use content created within the Service for that purpose. Axis does not use data retrieved from connected platform accounts for model training under any circumstances. You may withdraw from training at any time without charge and without any change to the functionality available to you.

6.1 Sending content to model providers

To generate content we send your prompts, brand settings and relevant material to the AI providers we use. They process it to return a result. They are bound by contract to use it only to provide the service to us.

6.2 What we may train on

  • Prompts, brand settings and instructions you give us inside Axis.
  • Content Axis generates for you, and the signals you give us about it, such as which drafts you keep, edit, discard or publish.
  • Aggregated and de-identified usage patterns.

6.3 What we never train on

  • Any data we retrieve from a platform you connect, including followers, audience data, comments, direct messages and performance metrics. The platforms prohibit it and so do we.
  • Payment or billing information.
  • The contents of your support conversations, except where you ask us to use them to fix a problem.

6.4 Opting out

You may withdraw from training in your account settings at any time, or by written notice to privacy@axismarketing.ai. Opting out applies going forward. Where content has already been used to train a model, it cannot be extracted from that model, but we will stop using your content for future training and will exclude it from future datasets.

Who we share it with

We do not sell your personal information for money. We share it only as follows.

  • Service providers who process it on our behalf under contract, listed by name on our Subprocessor page, which we keep current and update before adding a new one.
  • Platforms you connect, when you direct us to publish or retrieve something.
  • Professional advisers, such as lawyers and accountants, under duties of confidentiality.
  • Authorities and others, where we must comply with the law or legal process, or where we need to establish, exercise or defend legal claims, or protect the rights and safety of any person.
  • A buyer or successor, in a merger, acquisition, financing or sale of assets. We will tell you if your information becomes subject to a different policy.

International transfers

Axis is based in the United States and our infrastructure is in the United States. Wherever you are, your information is transferred to and processed there, and in other countries where our service providers operate.

For transfers out of the European Economic Area, the United Kingdom or Switzerland, we rely on the European Commission's Standard Contractual Clauses, together with the UK International Data Transfer Addendum and the Swiss addendum where relevant, and on additional technical and organizational measures. You may request a copy of the relevant safeguards from privacy@axismarketing.ai.

How long we keep it

Your rights

Depending on where you live you may have some or all of these rights, and we honour them for everyone where we reasonably can:

  • Access a copy of the personal information we hold about you.
  • Correct information that is wrong or incomplete.
  • Delete your information, subject to legal exceptions.
  • Export it in a portable, machine-readable format.
  • Object to processing based on legitimate interests, and to direct marketing at any time.
  • Restrict processing in certain circumstances.
  • Withdraw consent at any time, without affecting what was done before.
  • Opt out of targeted advertising and of any sale or sharing of personal information.
  • Not be discriminated against for exercising any of these rights.

Exercising your rights

Access, export and deletion are available directly in your account settings. For anything else, email privacy@axismarketing.ai. We will verify your identity before acting, and we will respond within the time the law where you live requires, and in any case without undue delay. An authorized agent may act for you where the law allows, with proof of authority.

Appeals and complaints

We will explain why. If you are in a US state that provides an appeal, you may appeal by replying to our decision with the word "appeal", and a different person will review it within 45 days. You may also complain to your data protection authority or attorney general. In the EEA, UK or Switzerland you may complain to your local supervisory authority.

Do Not Sell or Share

We do not sell personal information for money, and we do not share it for cross-context behavioral advertising except through advertising cookies, and only where you have consented to them.

You can withdraw that consent at any time using the Do Not Sell or Share My Personal Information link in our footer, or by changing your choice in the cookie banner. We also honour the Global Privacy Control signal automatically: if your browser sends it, we treat it as an opt-out without you needing to do anything else.

Cookies

We use cookies and similar technologies. Non-essential cookies load only after you consent, through a banner shown on your first visit. Every cookie and pixel we use, what it does and how long it lasts, is listed in the Cookie Policy.

Marketing messages

Email

We send service messages about your account that you cannot opt out of while you hold one. Marketing emails are separate, use confirmed opt-in, and carry a one-click unsubscribe link in every message.

SMS and WhatsApp

We send automated marketing texts only with your separate express written consent, given by ticking a box that is never bundled with anything else. Consent is not a condition of buying anything. Reply STOP to opt out and HELP for help. Message frequency varies and message and data rates may apply. Full details are in the SMS Program Terms.

Security

We use administrative, technical and organizational measures designed to protect personal information, including encryption in transit and at rest, access controls on a least-privilege basis, logging, and separation of customer data. Payment details are handled by Stripe under its own controls.

No system is perfectly secure and we cannot guarantee absolute security. If a breach affects your personal information we will notify you and the relevant authorities where the law requires, without undue delay. How to report a vulnerability to us is on the Security page.

Children

Axis is for adults. You must be at least 18, or the age of majority where you live if that is higher. We do not knowingly collect personal information from anyone under 18. If you believe a minor has given us information, contact privacy@axismarketing.ai and we will delete it.

Region-specific information

European Economic Area, United Kingdom and Switzerland

Sections 5, 8 and 10 set out our legal bases, our transfer safeguards and your rights. You may complain to your local supervisory authority at any time.

California

In the twelve months before the date of this Policy we collected the categories in section 2, for the purposes in section 4, from the sources in section 3, and disclosed them to the categories of recipient in section 7. We do not sell personal information. We do not knowingly collect or sell the personal information of anyone under 16. You have the rights in section 10, including the right to limit the use of sensitive personal information, which we do not intentionally collect.

Other United States states

Residents of states with comprehensive privacy laws, including Virginia, Colorado, Connecticut, Texas, Oregon, Montana and others, have the rights in section 10, including the right to opt out of targeted advertising and the right to appeal a refusal.

Canada, Australia, Japan, South Korea, Brazil and elsewhere

Where local law gives you rights over your personal information, we honour them. The mechanisms in section 10 apply wherever you are. Where local law requires a specific consent, notice or representative that differs from this Policy, that requirement applies in addition to it.

Changes and contact

We may update this Policy. We will change the version number and the date at the top and keep the previous version available. For a material change we will give notice in the Service or by email before it takes effect.
